Terms that govern access to and use of maureenzwickfoundation.org.
Effective date: September 15, 2026
These Terms of Use govern access to and use of https://maureenzwickfoundation.org/ and related pages, forms, downloads, and services that link to these Terms (the "Site"). The Site is operated by Maureen Zwick Foundation, a Colorado nonprofit incorporated July 20, 2026, with EIN 42-3950821 ("Foundation," "we," "us," or "our").
By using the Site, you agree to these Terms and the Privacy Policy (including how we handle cookies and similar technologies). If you do not agree, do not use the Site. We may update these Terms by posting a revised version with a new effective date.
The Foundation is an IRS 501(c)(3) public charity. Gifts are tax-deductible to the extent allowed by law. The Site provides information about the Foundation's mission and Rose, a home wellness companion intended to support people with dementia, Alzheimer’s, or cognitive decline and the families and caregivers who support them.
Site content is general information only. It is not medical advice, diagnosis, treatment, a cure, or a substitute for professional care. Rose is not a medical device and is not a substitute for professional care.
You may use the Site only if you can form a binding agreement under applicable law. If you use the Site for another person, including a person with cognitive decline, you represent that you have authority to do so and will explain these Terms and obtain any consent required by law. Parents and legal guardians are responsible for minors' use.
You must follow applicable law and any instructions shown on the Site. Do not rely on the Site or Rose for emergencies, supervision, medication decisions, diagnosis, treatment, or urgent safety decisions.
The Foundation owns or licenses the text, graphics, logos, designs, photographs, videos, software, and other materials on the Site ("Site Content"). Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use Site Content for personal, noncommercial, informational purposes. You may not copy, modify, distribute, sell, publicly display, create derivative works from, or commercially exploit Site Content without written permission, except as allowed by law.
The Foundation name, logos, and Rose name are not licensed by implication. The Foundation name, logos, and the Rose name may not be used without written permission, except as allowed by law.
If you submit a message, application, story, suggestion, photograph, memory, testimonial, or other content through the Site ("Submission"), you keep any ownership you have in it. You grant the Foundation a non-exclusive, worldwide, royalty-free license to host, store, reproduce, review, and use the Submission only as needed to operate, secure, improve, support, or communicate about the relevant service, or as separately authorized by you.
Do not submit content unless you have the right and authority to share it and to grant this license. Do not submit another person's voice, photograph, memory, or personal information without the required permission. We may remove or decline any Submission. See the Privacy Policy for data handling. Copyright concerns may be sent to info@maureenzwickfoundation.org.
The Site may link to third-party websites, app stores, payment pages, social networks, or other services. Current third-party providers include Netlify and Givebutter. Third parties control their own services and terms. The Foundation is not responsible for third-party content, availability, security, privacy practices, or transactions. Review their terms before using them.
Donation pages may be provided by Givebutter. A donation may be subject to the processor's terms and privacy policy. The Foundation will provide a gift acknowledgment or receipt as appropriate. A statement that gifts are tax-deductible means only to the extent allowed by law. No goods or services are provided in exchange for a gift unless the gift page says otherwise. Restricted gifts will be used for the stated purpose when accepted. Recurring gifts may be canceled through Givebutter or by contacting us. Refund requests are reviewed case by case.
We may change, suspend, or discontinue the Site or any feature at any time. We do not promise that the Site will be uninterrupted, secure, current, or error-free. We may correct errors and update content without notice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND SITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY. NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR RIGHT THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
The Foundation does not promise a particular outcome from the Site, Rose, fundraising, or any program. The Site is not a substitute for emergency services or professional medical, legal, financial, or caregiving advice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FOUNDATION AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, GOODWILL, REVENUE, OR PROFITS, ARISING FROM OR RELATED TO THE SITE OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THE FOUNDATION FOR CLAIMS ARISING FROM OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO THE FOUNDATION FOR THE RELEVANT SERVICE IN THE PRIOR 12 MONTHS. This section does not limit liability that cannot legally be limited.
To the extent allowed by law, you agree to defend, indemnify, and hold harmless the Foundation and its personnel from claims, losses, liabilities, costs, and expenses, including reasonable attorney fees, arising from your unlawful use of the Site, your Submission, your violation of these Terms, or your violation of another person's rights.
We may suspend or terminate access if we reasonably believe it is needed to protect people, data, the Site, or the Foundation, or to address a violation of these Terms. Sections that by their nature should continue, including ownership, disclaimers, limitations, indemnity, and dispute provisions, will continue.
These Terms are governed by the laws of Colorado, without regard to conflict-of-law rules. Courts located in Denver County, Colorado will have exclusive jurisdiction, subject to any mandatory rights you may have.
If a court finds part of these Terms unenforceable, the rest remains effective to the extent allowed by law. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them as part of a reorganization or transfer of a program. These Terms and documents they incorporate are the entire agreement about the Site, except for a separate written agreement.
